Uncontested divorce in New York (without children).

Personal assistance preparing divorce papers for an agreed New York divorce, with no children under 21 from the marriage. Call us to discuss your circumstances and service fee.

We are not attorneys. Our work supports people handling their own divorce case (pro se): we prepare documents from their information and instructions and provide administrative assistance. Read our service disclaimer ↗

The scope of our work

Prepared carefully, with personal follow-through.

An uncontested divorce is one in which the terms are settled rather than left for a contested court decision. For our service, this means no unresolved disagreement about property, debts, retirement interests or spousal maintenance, and no children under 21 from the marriage.

We prepare the paperwork using the facts and decisions you provide. We do not decide what you should agree to, negotiate with your spouse or advise you about your legal rights.

Included in the agreed scope

  • Collecting the facts needed for your divorce documents
  • Preparing the forms and checking for incomplete entries
  • Organizing the signature and notarization steps that apply
  • Administrative help with required service and electronic filing
  • Following up on missing items and any document corrections within our agreed work

Requirements for a New York divorce.

The court must have a qualifying New York connection, and the case must rely on a recognized legal ground. We collect the facts; a licensed attorney can advise you on their legal effect.

What New York residency connection is required?
  • Two years: either spouse has continuously resided in New York for the two years immediately before filing.
  • One year: either spouse has continuously resided here for the year immediately before filing, and the marriage occurred here, you lived here as a married couple, or the divorce ground arose here. For the marriage and marital-residence routes, that spouse must also be a resident when the case starts.
  • Both spouses currently live here: the ground arose in New York and both spouses are New York residents when filing.

A New York wedding alone is not enough. Residency and the proper filing county are separate questions.

Domestic Relations Law §230 ↗
What does no-fault mean, and is separation required?

The no-fault ground requires an irretrievable marital breakdown for at least six months, stated under oath by one spouse. Financial issues must be resolved before the court grants judgment. A prior legal separation is not required for this ground.

Other statutory grounds cover serious mistreatment, abandonment lasting at least a year, imprisonment for at least three consecutive years after marriage, adultery, and qualifying separation under a court decree or formal agreement. The current separation grounds require at least six months and compliance with the statutory formalities. Living at different addresses by itself does not establish those separation grounds.

Does our current service fit your situation?

We handle agreed divorces without children under 21 from the marriage. Tell us if your spouse will not sign, you cannot locate them, financial terms remain disputed, or another court case or order affects the marriage. We review service suitability before accepting work; some situations need an attorney.

Electronic filing and access

Your paperwork, with an online court record.

For an eligible NYSCEF matter, we prepare and organize the required papers and assist you with completing the electronic filing steps. We confirm county procedures, the documents required and who will submit them before work begins. As a self-represented party, you remain the filer responsible for reviewing and signing your papers.

We help you arrange your own NYSCEF account, subject to court registration and access rules. Once access is active, you can normally log in day or night to view documents in your case.

Usually handled through documents.

A straightforward uncontested divorce can often be reviewed without either spouse attending a routine court hearing. We help with the paperwork so you can avoid unnecessary courthouse trips.

The court may still request an appearance, additional documents or paper copies. Electronic filing does not replace the initial service requirements, and only a judge can grant the divorce.

Service fee and court fees

Know the costs before we start.

Our service fee is discussed by phone. Each matter receives individual attention. After reviewing the work involved, we agree on a fixed service fee and explain what it covers.

You pay these court fees directly to the court or County Clerk, not to AC Divorce Services. Our service fee is separate.

Before you decide

Questions about our service.

Can you help outside New York City?

Yes. We offer document preparation for New York clients, including the NYC boroughs, Long Island, Westchester and other counties. We confirm the filing method and local requirements for your county before accepting the work.

What if my spouse will not sign?

Tell us at the first conversation. Some cases proceed after proper service and a failure to respond, but they follow different requirements. A missing signature does not automatically qualify a case or guarantee a judgment. We confirm whether the request fits our service.

How long will the court take?

Preparation depends on complete information and signatures. Court review depends on the county, workload and any additional requests. We keep you informed about our work, but cannot promise the judge’s completion date.

How do we start?

Call (212) 507-9777. We discuss suitability and fees, then ask you to complete the client questionnaire. Have your marriage certificate, residence history and any existing agreement or court order available.

Will I have a lawyer?

Our service is document preparation and administrative assistance for people representing themselves. We are not attorneys or a law firm. Our professional background includes contract paralegal work in offices handling divorce and immigration cases; that experience does not make us your legal representative.
